Terms of Service for TicPop

1. Acceptance of these Terms
These Terms of Service ("Terms") are a binding agreement between you ("you", "user", "parent") and Velynq, Inc., a Delaware corporation ("Velynq", "we", "us", "our"), regarding your use of the TicPop mobile application, its website at ticpop.app, and any related services (collectively, the "Service").
By creating an account, downloading the Service, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
These Terms reference and incorporate our Privacy Policy, which explains how we handle your and your child's information.
2. Who may use the Service
- You must be at least 18 years old (or the age of majority in your country, whichever is higher) to create a TicPop account.
- You must be the parent or legal guardian of any child whose profile you create in the Service.
- You may not create an account on behalf of another adult without their express authorization.
- If you are a business, school, or other organization, contact us at support@ticpop.app before deployment — additional terms may apply.
3. Accounts
You are responsible for:
- Keeping your password secure and not sharing it with anyone.
- All activity that happens on your account.
- Notifying us promptly at support@ticpop.app if you suspect unauthorized use of your account.
We may suspend or terminate your account if you violate these Terms, attempt to defraud us, or use the Service in ways that harm other users, us, or third parties.
4. Subscriptions, free trials, and payments
4.1 Free tier
TicPop offers a free tier that includes up to 5 completed routine tasks in the first 7 days after account creation. After that, continued use requires a subscription.
4.2 Paid subscriptions
We offer paid subscriptions on a monthly or annual basis. Prices and subscription terms are disclosed inside the app before you purchase. All TicPop subscriptions are purchased and managed through the Apple App Store or Google Play. We do not offer web checkout.
4.3 Required disclosure — auto-renewing subscriptions (Apple App Store)
By purchasing a subscription through the Apple App Store, you acknowledge and agree that:
- Payment will be charged to your Apple Account at confirmation of purchase.
- Your subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected subscription.
- You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
- Any unused portion of a free trial will be forfeited when you purchase a subscription, where applicable.
4.4 Required disclosure — auto-renewing subscriptions (Google Play)
By purchasing a subscription through Google Play, you acknowledge and agree that:
- Payment will be charged to your Google Play account at confirmation of purchase.
- Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period.
- You can manage and cancel your subscriptions in your Google Play account settings.
4.5 Refunds
Refunds for TicPop subscriptions are handled by Apple and Google according to their respective policies. We cannot issue refunds for App Store or Play Store purchases directly. To request a refund, please contact Apple or Google through your account on the relevant store. We may also be able to assist if the issue relates to a service problem on our end — contact support@ticpop.app.
4.6 Price changes
We may change subscription prices from time to time. If we raise the price of an existing subscription, we will give you at least 30 days' notice by email and in the app. The new price will apply only to renewals after the notice period. You can cancel at any time to avoid the new price.
5. Acceptable use
You agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use bots, scrapers, or automated tools to access the Service
- Interfere with or disrupt the Service or its servers
- Attempt to gain unauthorized access to other users' accounts or data
- Resell, sublicense, or redistribute access to the Service
- Use the Service to harass, harm, or defraud others
- Upload content that is illegal, abusive, or violates intellectual property rights
6. Your content
You may create child profiles (choosing a nickname and a preset avatar) and create your own custom routines, tasks, and rewards ("Your Content"). You retain ownership of Your Content. By creating it in the Service, you grant us a limited license to store, sync across your devices, and display Your Content solely for the purpose of operating the Service for you. We do not allow user-uploaded photos. We will not share or publish Your Content outside of your account.
You are responsible for ensuring Your Content does not violate the rights of any third party.
7. Our intellectual property
The TicPop app, its design, code, logo, illustrations, audio, and all other materials we provide (except Your Content) are owned by Velynq, Inc. or our licensors and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal family use, subject to these Terms. No other rights are granted.
8. Availability and changes to the Service
- We may add, remove, or change features at any time.
- We may temporarily suspend the Service for maintenance or upgrades.
- We do not guarantee that the Service will be available 100% of the time, error-free, or secure.
- We may discontinue the Service with at least 60 days' notice to subscribers, in which case we will refund pro-rated any unused subscription portion (where Apple or Google's refund process allows).
9. Third-party services
The Service uses third-party services (Apple, Google, Supabase, PowerSync, RevenueCat, Sentry, Expo) described in our Privacy Policy. Your use of the Service is also subject to the terms of those services where they apply (e.g., Apple's App Store Terms, Google Play Terms).
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Any information or content provided through the Service is accurate or reliable
Some jurisdictions do not allow the exclusion of certain warranties. To the extent such exclusions are not permitted, the disclaimers above apply to the fullest extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by applicable law:
- In no event will Velynq, Inc., its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, data, use, or goodwill) arising out of or related to your use of the Service.
- Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100.
- These limitations apply whether the claim is based on contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the limitation of liability for certain damages (such as gross negligence, willful misconduct, or death / personal injury). These limitations do not apply where prohibited by law. Nothing in these Terms limits your non-waivable legal rights as a consumer.
12. Indemnification
You agree to indemnify and hold harmless Velynq, Inc., its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of:
- Your violation of these Terms
- Your violation of any third-party rights (including IP or privacy rights)
- Your Content
- Your misuse of the Service
13. Termination
You may stop using the Service and delete your account at any time (see Privacy Policy Section 11).
We may suspend or terminate your account at any time if:
- You violate these Terms
- We are required to do so by law
- Continued provision would be commercially impractical
On termination, Sections 4.5 (Refunds), 6 (Your Content license, in modified form), 7 (Our IP), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), 14 (Governing law), and 15 (Dispute resolution) survive.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. This does not deprive you of any mandatory consumer protections available in your country of residence, such as under EU consumer law or UK consumer law.
15. Dispute resolution
15.1 Informal resolution first
Before bringing any formal claim, you agree to contact us at support@ticpop.app and give us 30 days to try to resolve the dispute informally.
15.2 Arbitration (US users)
If you reside in the United States and an informal resolution is not reached, any dispute between you and Velynq relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Delaware, USA, unless otherwise agreed. You waive the right to a jury trial and the right to participate in a class action.
15.3 Court venue (non-US users)
If arbitration is not enforceable in your jurisdiction, or if you reside outside the United States, disputes shall be resolved in the competent courts of the State of Delaware, United States, or — where mandatory consumer laws of your country apply — in the courts of your country of residence.
15.4 Your statutory rights
Nothing in this Section 15 limits your right to bring claims before a consumer protection authority or any other body with jurisdiction under mandatory local law.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email (to the address on your account) and show a notice inside the app at least 30 days before the new Terms take effect. If you do not agree, you may delete your account before the effective date. Continued use after the effective date means you accept the updated Terms.
17. Severability
If any part of these Terms is held invalid or unenforceable, the remaining parts remain in effect.
18. No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
19. Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
